Terms of Use and Sale

Last updated: 30 October 2026

1. Acceptance and scope

These Terms govern the site, account creation, generation and editing tools, subscriptions and Facely credit purchases. By creating an account or using the service, you accept these Terms and the Privacy Policy. If you disagree, do not use the service.

You must have the legal capacity required to enter into this agreement. Mandatory consumer rights remain applicable.

2. Service and artificial intelligence

Facely helps create and edit scripts, images, voices and videos, including shorts, stories. Models, providers, formats, resolutions, processing times and features may change.

Kie.ai provides image and video generations. ElevenLabs produces the voice-over and the timing of its words, which is used for the subtitles. The Google Gemini API writes the scripts. When one of them is unavailable, Google Gemini or Kie.ai may stand in for the voice, the text or the transcription. Every output remains subject to the safety rules and terms of the selected model provider.

AI results are probabilistic and may be inaccurate, resemble other content or contain artifacts. Review them before publication. Facely does not guarantee an audience, virality, absolute originality or exclusive rights to an output.

3. Account and security

You must provide accurate information, keep access confidential and promptly report suspicious access. You may not share, resell or abusively automate your account, artificially multiply benefits or bypass a suspension.

4. Content and rights

You retain ownership of pre-existing content. You grant Facely a limited technical permission to host, copy, transform and transmit elements needed to fulfill your request, save your project, prevent abuse and provide support.

You confirm that you have the necessary rights and consents for images, videos, voices, music, brands and people shown. You are responsible for content you import, generate and publish.

5. Prohibited uses

You may not use Facely for illegal, fraudulent or deceptive activity; impersonation; exploitation or sexualization of minors; harassment or threats; infringement of others’ rights; malware distribution; bypassing credits, payments or safeguards; probing infrastructure; or reselling the service without written consent.

6. Plans, credits and limits

Each plan includes the credits, features, duration and usage limits shown on Pricing and before purchase. Generation cost varies by model, duration, resolution and options and must be displayed before launch.

Credits are personal, non-transferable, non-resellable and have no cash value. A paid operation may debit credits when it starts. When a recognized technical failure produces no result, the system may automatically restore the credits.

7. Pricing and payment

Price, currency, billing frequency, taxes and plan contents are shown before confirmation. Whop processes payment; Facely does not store complete card numbers. Paid access is granted only after server-side payment confirmation.

8. Renewal, changes and cancellation

Unless stated otherwise, subscriptions renew automatically for the selected period. You can cancel from Settings before the next renewal. Cancellation stops future payments and access normally remains active until the end of the paid period.

A plan change may adjust price and credits as shown during the operation. Failed payment or a serious breach may suspend access.

9. No refunds

All payments are final: Facely does not refund subscriptions, extra credits or top-ups, used or not. Before every payment, you request immediate access to the service and acknowledge losing your 14-day right of withdrawal by clicking the payment button, under the notice that says so (Directive 2011/83/EU, art. 16(m)).

A generation that fails on our side is automatically given back in credits. The legal guarantee of conformity still applies to a defective service. Details are in No refunds below; questions go to support@facely.eu.

10. Availability and changes

Facely uses reasonable efforts without guaranteeing uninterrupted operation. Maintenance, incidents, security requirements, force majeure or a provider decision may interrupt or alter a feature.

11. Suspension and account closure

Facely may block an operation or suspend an account when reasonably necessary to comply with law or protect a third party, the platform or its providers. You may request closure after exporting useful content. Some records may be retained for legal, accounting, security or evidentiary duties.

12. Liability

You remain responsible for publication choices, supplied data and keeping your own copies. To the extent allowed by law, Facely is not liable for indirect loss of audience, revenue, reputation or data caused by a third-party service or use contrary to these Terms. Nothing limits liability or consumer rights that cannot legally be limited.

13. Governing law and complaints

These Terms are governed by Belgian law without depriving consumers of mandatory protection in their country of residence. Send complaints to support@facely.eu. Consumers may also consult the Belgian Consumer Mediation Service.

14. Changes and contact

The version in force is dated at the top of this page. A material change affecting an active subscription will be communicated where required by law. Questions: support@facely.eu.

No refunds

Last updated: 30 October 2026

All payments on Facely are final: subscriptions, extra credits and top-ups are not refundable. Credits are available as soon as you pay, and every generation is paid to our AI providers as it runs.

Cancelling a subscription

A subscription stops at any time, from the Settings page, which opens your subscription management on Whop. No notice, no fee.

Cancelling stops future charges but does not refund the current period: you keep access and your credits until it ends.

No right of withdrawal

The 14-day right of withdrawal for distance purchases does not apply to digital content supplied immediately when the customer expressly requested it and acknowledged losing that right (Directive 2011/83/EU, art. 16(m); Belgian Code of Economic Law, art. VI.53).

Right below every payment button, a notice states that by paying you request immediate access to the service and acknowledge losing this right. Clicking that button is your agreement. Once payment is made, no withdrawal is possible.

Credits

Credits, used or unused, are not refundable, exchangeable for money or transferable.

Failed generations

A generation that fails because of a technical problem on our side automatically gives its credits back, with nothing to do. This is a credit correction, not a cash refund. If your credits are not back within the hour, write to us.

Defective service

This rule does not remove the legal guarantee of conformity: if the paid service does not work as described and we cannot fix it, the law still protects you. Write from your account address and mention the order; we answer within fourteen days at most.

If we disagree

Where a disagreement persists, a consumer in the European Union can refer the matter to a consumer mediator free of charge. Contact us first: most situations are settled in one exchange.

Writing to us

Any payment question goes to support@facely.eu.

Privacy Policy

Last updated: 30 October 2026

1. Introduction

Facely processes your personal information in accordance with Belgian law and the General Data Protection Regulation (GDPR). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you sign up to https://facely.eu/ (the "Site") and use our services.

Data controller: Facely. Privacy and data-rights contact: support@facely.eu.

2. Information We Collect

We collect account details (email, technical identifiers), usage data (projects, prompts, files, generated content, credit usage), technical logs (IP, browser, security events), billing identifiers from Whop, and messages you send to support. Card numbers stay with the payment provider. Facely runs no audience measurement: no analytics service receives the pages you visit, and nothing about your browsing leaves the site.

3. How We Use Your Information

We may use information collected about you via the Site to:

  • Create and manage your account.
  • Process your transactions and send related information, including purchase confirmations and invoices.
  • Deliver AI generation and store your projects.
  • Improve our Site and services.
  • Understand how you use our Site and which products are most relevant to you.
  • Communicate with you, including customer service, technical notices, updates and security alerts.
  • Send marketing communications, subject to your preferences.
  • Monitor usage and trends to improve your experience.
  • Comply with legal and regulatory obligations.

4. Legal Basis for Processing

We only process personal data where we have a legal basis to do so:

  • Your consent (where you have given consent).
  • Performance of a contract with you.
  • Compliance with legal obligations.
  • Our legitimate interests, where those interests are not overridden by your rights (security, fraud prevention, service improvement).

5. Disclosure of Your Information

We use the following providers to operate Facely:

  • Supabase: authentication, account data, database, project metadata and credit ledger.
  • Cloudflare: site delivery, security and private R2 storage for uploaded and generated images, videos and audio.
  • Google: Cloud Run API hosting, Google sign-in, YouTube content you choose to import or embed. The site serves its own fonts: none are loaded from Google.
  • Kie.ai: our image and video generation API. The prompt, selected model and required input images are sent to Kie.ai for your request. When Google Gemini or ElevenLabs is unavailable, Kie.ai also serves as a fallback for script writing and voice synthesis.
  • Kie.ai (transcription): fallback for subtitle transcription. The audio track to transcribe is sent to Kie.ai and may be processed there by a Google model.
  • Groq: optional fallback for subtitle transcription, used only if it is enabled. Only the audio track is sent; no prompt, script or video reaches Groq.
  • ElevenLabs: voice synthesis, our main voice provider. The voice-over script, the selected voice and the language are sent to generate the audio and its word timing, which is used for the subtitles.
  • Sentry: error monitoring. When a technical error occurs, a report (error message, technical stack, browser type and the page address without its parameters) is sent to Sentry. No prompt, script, image, cookie or payment detail is included.
  • Google Gemini API: script writing; voice synthesis when ElevenLabs is unavailable; and subtitle transcription for a voice you upload or a video you clip. Your idea, the script or the audio track are sent for the requested step only.
  • Resend: sending account emails (confirmations, reminders and service information). Your email address and the content of the message are sent to it.
  • Whop: subscriptions, credit purchases, billing identifiers and payment processing; full card details stay with Whop.
  • By law or to protect rights: if release is necessary to respond to legal process, investigate violations of our policies, or protect the rights, property and safety of others.
  • Business transfers: in connection with a merger, sale of assets, financing or acquisition.

We do not sell your personal data. Content sent to a model is limited to what is needed for the requested generation. Depending on the model you select, Kie.ai may route processing to the underlying model provider, including Google, OpenAI, xAI, Kuaishou/Kling, ByteDance, Black Forest Labs, MiniMax or another provider clearly named in the model picker.

6. International Transfers

Your information may be transferred to, and processed in, countries other than the country in which you are resident. These countries may have data protection laws that are different from the laws of your country. Where required, we rely on an adequacy decision or standard contractual clauses, with additional measures when needed.

7. Data Retention

We retain personal data only as long as necessary for the purposes we collected it for, including legal, accounting and reporting requirements. Account and project data remain while the account is active. You may delete projects in the product when that function is available. Billing records are kept for statutory accounting periods.

8. Your Data Protection Rights

Under the GDPR, you have the following rights:

  • Access: request copies of your personal data.
  • Rectification: request that we correct inaccurate or incomplete information.
  • Erasure: request deletion, subject to legal retention duties.
  • Restriction and objection: in the cases provided by law.
  • Portability: receive data you provided in a structured format.
  • Withdraw consent: for future processing, without affecting prior lawful processing.

Send requests to support@facely.eu. You may lodge a complaint with the Belgian Data Protection Authority.

9. Cookies

We use storage strictly necessary for session, security and interface preferences. No measurement or advertising cookie is set by Facely, and there is no consent banner because there is nothing optional to consent to. Whop applies its own mechanisms during checkout.

10. Contact

Questions about this policy: support@facely.eu.

Cookie policy

Last updated: 30 October 2026

This page describes what Facely stores in your browser, and why. Everything listed is needed for the site to work: there is nothing optional to refuse.

Cookies and local storage

Facely uses local storage only for the preferences the site needs to work. No audience-measurement cookie is set, no advertising tracker either, and no browsing data is sent to any analytics service.

What is stored

Information Facely stores in your browser
ItemWhat it doesStatus
Sign-in session (Supabase)Keeps you signed in from page to page. Without it you would retype your password on every screen.Necessary
Chosen languageShows the site again in the language you selected.Necessary

Nothing to refuse

Facely does not measure its audience. There is therefore no consent banner, no choice to make and no decision to come back and change: the site stores only what it needs to keep you signed in and to show itself in your language.

Third-party services

Paying happens on Whop's own site, under Whop's policy. An embedded YouTube video is loaded from YouTube and follows Google's policy. Facely has access neither to your payment details nor to what those services store on their side.

Security

Last updated: 30 October 2026

Facely uses defense in depth to protect accounts, projects, credits and files.

Infrastructure and data

Connections use TLS. Files are isolated by account in Cloudflare R2 and delivered through temporary signed URLs. Application data uses row-level access controls in Supabase.

Authentication and access

Sign-in is managed by Supabase Auth. Provider secrets stay server-side, paid operations are validated by the API and internal access follows the principle of least privilege.

Payments and abuse prevention

Whop processes payment data. Webhooks are verified before a plan or credits are granted. Rate limits, cost controls and file validation reduce fraud and unauthorized processing.

Report a vulnerability

Email support@facely.eu with reproduction steps and the estimated impact. Do not access anyone else’s data, disrupt the service or disclose the issue publicly before allowing reasonable time for a fix.

Legal information

Legal notice

Last updated: 30 October 2026

1. Service publisher

Facely is the trade name and publisher of the online service available at facely.eu.

Contact
support@facely.eu

General contact, support, legal requests and reports: support@facely.eu. Contractual and billing information applicable to an order is also shown before payment and on the corresponding records.

2. Hosting and infrastructure

The site is delivered by Cloudflare. The API runs on Google Cloud Run and files are stored in Cloudflare R2. Supabase provides authentication and the database. Kie.ai generates images and videos, ElevenLabs the voices and the Google Gemini API the scripts. Resend sends account emails. Whop processes payments. Sentry receives technical error reports, and Groq may serve as a fallback for subtitle transcription. No audience-measurement service is used. Google services provide Google sign-in and YouTube; the site serves its own fonts.

Facely neither receives nor stores complete card numbers. Data transfers and subprocessors are detailed in the Privacy Policy.

3. Purpose of the service

Facely is software for creating, transforming and editing AI-assisted scripts, images, voices and videos. Available models, formats, credits and limits may change to preserve service quality, security and continuity.

4. Intellectual property

The Facely brand, visual identity, interface, copy and components are protected. Unauthorized reproduction or use is prohibited. Third-party brands and models remain the property of their owners; references describe technical compatibility, not endorsement.

5. Editorial responsibility and third-party content

You remain responsible for imported, generated and published content and for obtaining the necessary rights to images, voices, music, brands and represented people. External links and third-party providers are governed by their own terms.

6. Availability and security

Facely implements reasonable availability and security measures without guaranteeing uninterrupted operation. Maintenance, an incident, a security requirement or a provider outage may temporarily affect a feature.

To report a vulnerability, unlawful content or infringement, see the Security page or email support@facely.eu.

7. Applicable documents

Use of Facely is governed by the Terms of Use and Sale, the Privacy Policy and information shown before each order. Mandatory provisions of applicable law take precedence.
